Terms and Conditions

1. Agreement to Terms

These Terms and Conditions ("Terms") govern your use of PazGolf and any related services (the "Service") provided by PazGolf Ltd, a company registered in Northern Ireland (Company No. NI733614), with its registered office at 180a Belfast Road, Newtownards, Northern Ireland, BT23 4TA ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Account Registration

2.1. Eligibility

You must be at least 18 years old to create an account or subscribe to the Service. If you are registering on behalf of a golf club, society, catering business, or other organisation, you confirm that you have the authority to bind that organisation to these Terms.

2.2. Your Responsibilities

When you create an account, you agree to:

1. Provide accurate, current, and complete information during registration.
2. Keep your login credentials confidential and not share them with any other person.
3. Notify us immediately if you become aware of any unauthorised use of your account.
4. Accept responsibility for all activity that occurs under your account.

3. Subscription Plans and Licence

3.1. Subscription Plans

Access to the Service is provided through the following subscription plans. Current pricing for each plan is displayed on our website at paz.golf at the time of purchase.

Subscription Plan	Description	Intended Use
PazGolf Personal	Annual subscription for individual golfers. Includes personal handicap tracking, digital scorecards at any course, ability to form and join societies, and competition entry.	For individual golfers who want to track their handicap and participate in societies.
PazGolf Lite	Monthly subscription for golf clubs and venues, billed in arrears at a capped monthly fee that is reduced by Snax commission invoiced at your venue in the same calendar month, down to zero (see Section 4.2). Includes two QR codes (fourball and society), digital scorecards for visitors and members, side games, society competitions for up to 48 players, live leaderboards, and QR access codes for society days.	For clubs that want instant digital scoring for visitors and casual rounds with minimal setup.
Golf Society	Monthly subscription for golf societies. Includes unlimited competitions and formats, society handicap tracking, golf day management, member management, and digital scorecards with leaderboards.	For golf societies that want to run competitions and track handicaps year-round.
PazGolf Club	Monthly subscription providing the full platform. Includes everything in PazGolf Lite, plus year-round handicap management, unlimited competitions and formats, winter league support, custom course creation, and unlimited internal societies.	For clubs that want full competition management, year-round handicapping, and advanced features.
PazGolf Snax	Commission-based service for caterers and food & beverage providers. Includes on-course food and drink ordering and society pre-order management. No setup fee or monthly subscription; commission charged on orders processed through the platform.	For caterers operating at venues with a PazGolf Lite or Club subscription.
Golf Trip	One-off purchase for multi-day golf trips (two or more rounds). Priced per player with a maximum cap per trip. Includes aggregate leaderboards across all days, side games, team match play events with captain picks and reveal screens, offline scoring, and easy invite links. Discounted rates available for PazGolf subscribers.	For organisers running multi-day golf trips, particularly team match play events.

3.2. PazGolf Snax Requirements

PazGolf Snax is available only at venues that hold an active PazGolf Lite or PazGolf Club subscription. Use of Snax by Providers (caterers and food & beverage operators) is governed by the separate PazGolf Snax Terms and Conditions, which includes commission rates, invoicing, and payment terms. If a venue's Lite or Club subscription is cancelled or lapses, Snax access at that venue will end immediately.

3.3. Golf Trip Purchases

Golf Trip is a one-off purchase for multi-day golf trips (two or more rounds), not a recurring subscription. The following terms apply specifically to Golf Trip:

1. Golf Trip is priced per player, with a maximum cap per trip as displayed on our website at the time of purchase. Once the cap is reached, additional players may be added at no extra cost.
2. Discounted rates are available for users with an active PazGolf subscription (Personal, Lite, Golf Society, or Club).
3. Payment is due at the time of creating the trip. The trip organiser is responsible for payment regardless of how many players ultimately participate.
4. Golf Trip does not automatically renew. Each trip requires a separate purchase.
5. The trip organiser may add or remove players at any time before and during the trip. No refunds are given for players who do not participate.

3.4. Golf Day vs Golf Trip

Golf Society and PazGolf Club subscriptions include Golf Day functionality for single-day events, which covers competition setup, player groupings, tee times, and leaderboards for that day. Golf Day does not include multi-day aggregate leaderboards, team match play with captain picks and reveal screens, or other features exclusive to Golf Trip. Organisers requiring these features for multi-day events must purchase Golf Trip separately.

3.5. Grant of Licence

Subject to your compliance with these Terms, PazGolf grants you a limited, non-exclusive, non-transferable, non-sub-licensable licence to access and use the Service consistent with your purchased Subscription Plan and Subscription Term.

3.6. Licensing Restrictions

You agree that:

1. PazGolf Personal subscriptions are for individual, non-commercial use only. Using a Personal subscription to operate club or society administration on behalf of a business requires a Lite, Golf Society, or Club subscription.
2. PazGolf Lite subscriptions are limited to the features and player capacities specified for that plan. Clubs requiring additional features such as year-round handicap management or internal societies must upgrade to PazGolf Club.
3. Golf Society subscriptions are for independent golf societies only. Clubs wishing to manage internal societies as part of club operations require a PazGolf Club subscription.
4. Sharing access credentials is strictly prohibited across all plans and may result in immediate termination of your subscription.

3.7. Upgrades and Downgrades

You may upgrade your subscription at any time. When you upgrade, the new plan's features are available immediately and the new plan's fee (at the rate displayed for that plan at the time you upgrade) applies from your next bill; for plans billed in arrears there is no separate pro-rata charge for the month in which you upgrade. Downgrades take effect at the end of your current billing period. Features exclusive to your previous plan will no longer be available after the downgrade takes effect.

3.8. General Restrictions

You agree not to:

1. Copy, modify, or create derivative works of the Service or any of its content.
2. Reverse engineer, decompile, or disassemble any portion of the software.
3. Use any automated means, including bots, scrapers, or data mining tools, to access or collect data from the Service.
4. Use the Service to build or assist in building a competing product or service.
5. Attempt to circumvent, disable, or interfere with any security features of the Service.
6. Remove, alter, or obscure any proprietary notices or branding within the Service.

4. Payment, Billing, and Renewals

4.1. Fees and Pricing

You agree to pay the fees applicable to your chosen Subscription Plan or one-off purchase (such as Golf Trip) as displayed on our website at the time of purchase. All fees are quoted in the currency displayed at checkout and are exclusive of applicable taxes, duties, and charges unless otherwise stated. PazGolf reserves the right to change its prices at any time, provided that any price change for existing subscribers will take effect on the next renewal date of your Subscription Term, and you will be notified at least thirty (30) days in advance.

For PazGolf Lite, the fee is a capped monthly amount, and the cap in force when you subscribed remains your cap: a change to the advertised cap applies to new subscribers, not to you. If we ever change the cap for existing subscribers, we will give you at least 30 days' notice and ask you to accept the updated Terms before the change applies to your venue.

4.2. Billing Periods

Subscriptions are billed on a recurring basis according to the billing period applicable to your plan. PazGolf Personal is billed annually in advance. Golf Society and PazGolf Club are billed monthly. Golf Trip is a one-off payment due at the time of purchase and does not recur. PazGolf Snax is commission-based and billed under the Snax Terms.

PazGolf Lite is billed monthly in arrears on calendar months. At the end of each calendar month we calculate your capped platform fee, reduce it by the Snax commission invoiced at your venue for that same calendar month (down to zero), and collect the balance straight away from your saved payment method; there is no credit period. For the calendar month in which you subscribe, the platform fee is pro rata: it covers the days from the day you subscribe to the end of that month (for example, subscribing on 7 July, a 31-day month, you pay 25/31 of the monthly fee). If you subscribe in the last ten days of a calendar month, the platform fee for that month is waived. An invoice is issued for every month, including months where the amount due is zero. Where your venue's own bar or kitchen owes Snax commission, both amounts appear on one monthly invoice (see the Snax Terms, Section 7.7).

4.3. Automatic Renewal and Payment Authority

All subscriptions will automatically renew for successive periods of the same duration as your initial Subscription Term, unless you cancel your subscription prior to the renewal date. For annually billed plans we will send you a reminder at least fourteen (14) days before each renewal. By providing payment information, you authorise PazGolf to charge your provided payment method for the fees due. Where you pay by Bacs or SEPA Direct Debit, collections are made under the Direct Debit mandate you set up at checkout, and our payment processor (Stripe) sends you the mandate confirmation and advance notice of each collection.

4.4. Failed Payments

If a payment fails, we will email you the same day the failure is confirmed, with instructions for updating your payment method. If the amount remains unpaid seven days after that notice, we may pause the parts of the Service your subscription pays for: for a PazGolf Lite club this means your QR codes stop admitting new visitor sessions and instead direct golfers to contact the club office. Rounds already in progress are never interrupted, and nothing shown to golfers will reference your account. Access is restored automatically, and immediately, once all outstanding amounts are settled; saving a working payment method allows us to retry the outstanding amount automatically.

4.5. Invoice Queries

If you believe an invoice is wrong, tell us in writing at [email protected] within fourteen (14) days of the invoice date, with details of the items you dispute. We will review it and reply within a reasonable time. Where we agree an amount was wrong, we will refund or credit it. The undisputed part of the invoice is collected as normal.

5. Cancellation and Refunds

5.1. Cancellation by User

You may cancel your subscription at any time through your account settings at paz.golf or by contacting us at the details in Section 13. For plans billed in advance, cancellation takes effect at the end of your current paid Subscription Term, and you keep access to the Service until that date. PazGolf Lite, billed in arrears, is cancelled from your subscription page: cancellation takes effect at the end of the calendar month in which you cancel, the Service keeps working until then, and that month is billed as normal; nothing is billed after it. You can withdraw the cancellation from the same page before that month ends.

5.2. Cooling-Off Period

If you are a consumer subscribing as an individual (including PazGolf Personal), you have the right to cancel your subscription within 14 days of purchase under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, without giving any reason. To exercise this right, you must notify us before the 14-day period expires. If you have used the Service during this period, you may be charged a proportionate amount for the service provided up to the point of cancellation.

5.3. Refunds

Outside of the cooling-off period described in Section 5.2, all subscription fees are non-refundable. We do not provide refunds or credits for any partial subscription period or unused features. Exceptions may be made only as required by applicable law.

5.4. Golf Trip Refunds

Golf Trip purchases are non-refundable once the trip has been created, except during the 14-day cooling-off period if the trip start date falls after that period and you have not yet used any features of the trip. If the trip start date falls within the 14-day cooling-off period, you may cancel before the trip starts for a full refund. No refunds are given for players who do not participate or for trips that have already commenced.

5.5. Termination by PazGolf

PazGolf reserves the right to suspend or terminate your subscription and access to the Service immediately and without refund if you breach any of these Terms, including but not limited to payment failures, unauthorised use of the software, credential sharing, or infringement of intellectual property.

6. Acceptable Use

When using the Service, you agree not to:

1. Submit false, manipulated, or fraudulent scores or handicap data.
2. Harass, abuse, threaten, or intimidate other users of the Service.
3. Upload or share any content that is unlawful, defamatory, obscene, or otherwise objectionable.
4. Use the Service for any purpose that is illegal or prohibited by these Terms.
5. Interfere with or disrupt the integrity or performance of the Service.
6. Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.

We reserve the right to remove any content and suspend or terminate any account that violates this Section, at our sole discretion and without prior notice.

7. Intellectual Property and Content

7.1. Ownership

The Service, including all software, code, algorithms, graphics, course designs, text, and other proprietary materials, is the exclusive property of PazGolf Ltd or its licensors and is protected by copyright, trademark, and other intellectual property laws. PazGolf is a trademark of PazGolf Ltd. You receive only a licence to use the Service as described in these Terms, not ownership of any part of it.

7.2. User-Generated Content

Where the Service allows you to upload, post, or share content (e.g., custom course data, society information, or other materials), you retain all ownership rights in your content. By submitting content to the Service, you grant PazGolf a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, and display that content solely for the purpose of operating, improving, and promoting the Service.

PazGolf reserves the right to remove any user-generated content that, in our reasonable opinion, violates these Terms or is otherwise objectionable.

8. Data Protection and Privacy

8.1. Personal Data

We take the protection of your personal data seriously. Our collection, use, and storage of your personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

8.2. Data Processing for Clubs, Societies and Venues

Where a golf club, society, venue or other organisation that subscribes to the Service uses it to manage its members' or players' data (handicap records, scores, competition entries and membership details), that organisation is the controller of that data and PazGolf is its processor, under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 and, where that organisation is established in, or its members are in, the European Economic Area, the EU GDPR. Section 8.4 sets out the terms on which we process that data, and meets the requirements of Article 28 of the UK GDPR and of the EU GDPR. Each subscribing organisation is responsible for having a lawful basis for sharing its members' personal data with us.

8.3. Your Rights

You have the right to access, rectify, or request deletion of your personal data, subject to any legal obligations that require us to retain certain records. To exercise these rights, please contact us at the details in Section 13.

8.4. Processor Terms

When we process personal data for you under Section 8.2:

1. Subject and duration. We process it to provide the Service, for as long as you use the Service and then as set out in (h).
2. Nature and purpose. Storing, displaying and calculating with it (handicaps, scores, competitions, entries, orders) as the Service's features require.
3. Types of data and people. Names, contact details, handicap and scoring records, competition entries, photos you or your players upload, and Snax orders, of your members, players and guests.
4. Instructions. We process it only on your documented instructions, which are these Terms and your use of the Service's settings, unless the law requires otherwise (and then we tell you first unless the law forbids it).
5. Confidentiality and security. Everyone at PazGolf who can reach it is bound to confidentiality. We keep the measures in Section 11 of our Privacy Policy, including encryption in transit and at rest.
6. Sub-processors. You authorise the sub-processors we use to run the Service, of the kinds described in Sections 5.1 and 6 of our Privacy Policy; we give you the list on request. We will tell you at least thirty (30) days before adding or replacing one, and you may object; if we cannot address your objection you may cancel. We impose the same data protection obligations on each sub-processor and remain responsible for them.
7. Help. We help you, as far as the Service reasonably allows, to answer requests from people exercising their rights, to keep your data secure, and with any data protection impact assessment or consultation with a supervisory authority. We tell you without undue delay, and in any case within 48 hours, after becoming aware of a personal data breach affecting your data.
8. End of the Service. When you stop using the Service you can ask us for a copy of your data first. We then delete it as set out in Section 7 of our Privacy Policy, unless the law requires us to keep it.
9. Audits. We make available the information you reasonably need to show these obligations are met, and allow and contribute to reasonable audits, on reasonable notice and at your cost.
10. Transfers. We transfer your data outside the UK and the European Economic Area only as described in Section 6 of our Privacy Policy.

9. Third-Party Services

The Service may integrate with or rely on third-party services, including payment processors and external platforms. PazGolf is not responsible for the availability, accuracy, or content of any third-party services, and your use of such services is subject to their own terms and conditions. Any outage or issue caused by a third-party provider is outside our control, and we shall not be liable for any loss or disruption arising from such events.

10. Disclaimer of Warranties and Limitation of Liability

10.1. Disclaimer of Warranties

The Service is provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, PazGolf makes no warranties, express or implied, regarding the Service, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.2. Limitation of Liability

To the maximum extent permitted by law, PazGolf shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Service. In no event shall PazGolf's total liability exceed the amount of fees paid by you for the Service during the twelve (12) months preceding the claim.

10.3. Exceptions

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by the laws of Northern Ireland.

11. Hardware, Maintenance, and Support

11.1. Hardware Requirements

The Service may require specific third-party hardware (such as a phone, tablet, or display screens) to function. You are solely responsible for acquiring, maintaining, and ensuring the compatibility of all necessary hardware. PazGolf does not warrant the operation of the Service with any specific third-party hardware.

11.2. Maintenance and Updates

PazGolf may release updates, upgrades, and modifications to the software from time to time. You agree that PazGolf is not obligated to provide any specific level of support, maintenance, or updates, except as explicitly defined by your Subscription Plan.

12. General Provisions

12.1. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least thirty (30) days before the changes take effect, and we will ask you to accept the updated Terms explicitly (for subscribing organisations, this happens in your dashboard). We do not treat silence or continued use alone as acceptance of a material change. If you do not agree with the changes, you may cancel your subscription before they take effect.

12.2. Governing Law and Jurisdiction

These Terms are governed by and shall be construed in accordance with the laws of Northern Ireland. Any dispute arising out of or in connection with these Terms shall be subject to the jurisdiction of the courts of Northern Ireland, without prejudice to any rights you may have as a consumer to bring proceedings in your local courts.

12.3. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

12.4. Entire Agreement

These Terms, together with our Privacy Policy and any other documents expressly referred to herein, constitute the entire agreement between you and PazGolf in relation to the Service and supersede all prior agreements, understandings, and representations.

12.5. Force Majeure

PazGolf shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, internet service disruptions, government actions, or pandemics.

12.6. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

12.7. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. PazGolf may assign its rights and obligations under these Terms without restriction.
